The Portuguese legal system is a mixed legal system based partly on Roman law. Portugal is a civil law country, that is, a system based on written sources of law. Sources of law include the constitution, laws, regulations and court decisions. The Portuguese legal system has a structure in which three separate powers are separate from each other: legislative, executive and judicial. The legislative body is the Parliament and is responsible for creating and passing laws. The executive branch is the government and is responsible for enforcing the laws. The legal system in Portugal includes regulations in different areas such as civil law, criminal law, administrative law and labor law. While civil law regulates private law relations, criminal law deals with issues related to crime and punishment. Administrative law regulates the state's execution of public services and its relations with citizens. Labor law regulates labor relations. Courts in Portugal are divided into two categories: general courts and special courts. While general courts deal with civil and criminal cases, special courts are courts that specialize in certain matters. For example, labor courts, administrative courts and constitutional courts. The Portuguese legal system must also be compatible with EU law because Portugal is a member of the European Union. Therefore, the supremacy of EU law is accepted and the integration of EU law into domestic law is ensured. EU law is part of the Portuguese legal system and any local legal regulation that contradicts EU law is deemed invalid.
